1.Brand & Legal Operator

onlytrend.shop is a brand name and trade identity operated by Mithaq ("the Company", "we", "us", "our"), a company duly licensed and registered in the State of Kuwait. References throughout these Terms to "onlytrend.shop", "the Store", or "the platform" refer to the digital store operated by Mithaq.

The brand name "onlytrend.shop" does not create any separate legal personality, and no rights, claims, or liabilities attach to the brand name independently of Mithaq. Any legal relationship, contract, or transaction you enter through this website is exclusively with Mithaq as the licensed operator. You acknowledge and accept this brand-operator structure as a condition of using the website.

2.Definitions

• Website / Store — the online store accessible at onlytrend.shop
• Company / Operator — Mithaq, the licensed registered entity operating the Store
• Brand — "onlytrend.shop", a trade name used for display and marketing only
• Products / Goods — any physical or digital items offered for sale
• Customer / You — any person who browses, registers, or purchases
• Consumer — a natural person purchasing for personal, non-commercial use

3.Business Registration & Legal Identity

In compliance with Decree Law No. 10 of 2026 (Art. 3), the licensed operator discloses the following mandatory information:

Mithaq is registered in the digital commerce records maintained by the Ministry of Commerce and Industry (MoCI), as required by Decree Law No. 10 of 2026.

4.Acceptance of Terms

By accessing, browsing, registering on, or purchasing through onlytrend.shop, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy. If you do not agree, you must immediately stop using the website.

You further warrant that all information you provide is true, accurate, and current, and that you will keep it updated. We reserve the right, at our sole discretion and without liability, to refuse service, restrict access, cancel orders, or remove content from any user at any time.

5.User Registration & Accounts

To complete purchases, you must create an account providing your full name, email address, mobile number, delivery address, and a password. You must be at least 18 years of age to register and purchase.

You are solely responsible for maintaining the confidentiality of your password and for all activities carried out under your account, whether authorized by you or not. The Company shall not be liable for any loss or damage arising from unauthorized use of your account caused by your failure to protect your credentials. Notify us immediately at operations@onlytrend.shop of any suspected unauthorized use.

6.Product Descriptions & Pricing

We make reasonable efforts to display accurate product descriptions, images, and prices. However, images are for illustrative purposes only, and actual products may differ slightly in colour, texture, or appearance due to screen settings, photography, or manufacturing variation. Such minor variations do not constitute a defect or grounds for a claim.

All prices are in Kuwaiti Dinar (KWD). We reserve the right to change prices, withdraw products, or limit order quantities at any time without prior notice. In the event of a pricing or typographical error, we are not obliged to honour the incorrect price and may cancel the affected order, even after confirmation, offering you either the corrected price or a full refund of any amount already paid.

7.Order & Contract Formation

Your order constitutes an offer to purchase. No binding contract exists until we issue an order confirmation to your registered email or mobile number. We are under no obligation to accept any order and may decline or cancel any order — in whole or in part — for any reason, including stock unavailability, pricing errors, suspected fraud, or breach of these Terms, without liability beyond refunding any sum already paid for the cancelled item.

All electronic contracts formed through this Store are valid and enforceable under Law No. 20 of 2014 on Electronic Transactions and Decree Law No. 10 of 2026.

8.Payment

Payments are processed through secure, licensed payment gateways compliant with Central Bank of Kuwait regulations. We accept credit/debit cards (Visa, Mastercard, KNET), digital wallets where available, and cash on delivery for eligible orders within Kuwait.

Payment is debited upon verification of your order. We do not store your full card details. Any payment-gateway fees will be shown at checkout before you confirm. We reserve the right to add, modify, or remove payment methods at any time without prior notice.

9.Delivery & Shipping

We deliver to the address you provide at checkout. You are solely responsible for the accuracy of that address; we are not liable for failed or delayed delivery, or any associated cost, resulting from incorrect or incomplete address details provided by you.

Delivery times are good-faith estimates only and are not guaranteed. Delays caused by customs, couriers, public holidays, weather, or other factors beyond our reasonable control do not entitle you to cancel a dispatched order or claim compensation, except where required by applicable Kuwait law. Risk passes to you upon delivery. Report any transit loss or damage within 48 hours of the scheduled delivery date, failing which the goods are deemed accepted.

10.Returns & Refunds

To request a return or exchange, contact customer service via WhatsApp at [WHATSAPP NUMBER] or email [EMAIL] within 14 days of the invoice date, providing the original invoice and the product in its original, unused, resalable condition with all packaging, tags, and seals intact.

To protect us from abuse while respecting your legal rights, the following items are non-returnable unless faulty or materially misdescribed:

• Customized, made-to-order, or personalized products
• Underwear, swimwear, and sealed hygiene/cosmetic items once unsealed
• Perishable goods and consumables once opened
• Digital goods or software once downloaded or activated
• Items on final clearance/sale, where clearly marked at the point of purchase

Returns are rejected where goods show signs of use, wear, damage, or tampering caused by you or a third party. Original and return shipping costs for non-defective returns (e.g. change of mind) are borne by you. Refunds for valid returns are processed to the original payment method within a reasonable period after we inspect and approve the returned item.

11.Consumer Rights

In accordance with Consumer Protection Law No. 39 of 2014 and Decree Law No. 10 of 2026, you are entitled to accurate product information, the right to cancel within 14 days (except non-returnable items), a cash refund where legally required, safe and conforming products, and the right to file a complaint. These statutory rights cannot be waived and prevail over any conflicting provision in these Terms.

12.Data Protection & Privacy

We process your personal data in accordance with Data Protection Regulation No. 26 of 2024 under CITRA oversight. We collect data to process orders, manage your account, communicate with you, comply with the law, and improve our services. Data may be shared with logistics and payment providers and government authorities only as strictly necessary. We do not sell your personal data. 13.Cookies

We use cookies to remember your preferences and cart, analyse usage, and enable secure sessions. Cookies we set do not personally identify you or track you across third-party sites. 14.Intellectual Property

All content on onlytrend.shop — including the "onlytrend.shop" brand, the Mithaq name, logos, text, product images, graphics, design, layout, and software — is the exclusive property of Mithaq or its licensors and is protected under Kuwait Copyright Law and other applicable IP laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the Store for lawful personal, non-commercial purposes only. You may not copy, reproduce, scrape, resell, distribute, republish, modify, or commercially exploit any content without our prior written consent. Unauthorized use of our brand names or trademarks is strictly prohibited and may result in legal action under Decree Law No. 10 of 2026 (Art. 15).

15.Prohibited Conduct

You may not use the Store to post abusive, defamatory, fraudulent, obscene, or hateful content; engage in illegal activity; access the platform by automated means without consent; transmit viruses or malware; attempt unauthorized access; send spam; or infringe any third party's rights. Violations may constitute offences under Cybercrime Law No. 63 of 2015 and will be reported to the competent authorities, with your identity disclosed as permitted by law.

16.Disclaimer & Limitation of Liability

The Store and its content are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by Kuwait law. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, the Company's total aggregate liability to you arising from or in connection with any order or these Terms shall not exceed the value of the goods giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, revenue, data, or anticipated savings.

17.Indemnification

You agree to indemnify and hold harmless Mithaq and its owners, officers, employees, agents, and suppliers against all claims, losses, damages, liabilities, and reasonable legal costs arising from your breach of these Terms, your misuse of the Store, or your violation of any law or third-party right.

18.Account Suspension & Termination

You may close your account at any time by contacting us. We reserve the right to suspend, restrict, or permanently terminate your account and access to the Store at our sole discretion, with or without notice, where we reasonably believe you have breached these Terms, engaged in fraudulent or abusive conduct, or where required by law. Suspension or termination does not affect any order already lawfully completed or any accrued obligation between us.

19.Taxes & Duties

You are responsible for any applicable taxes, customs duties, or government charges on your order. For international orders, destination-country duties and taxes are your sole responsibility.

20.Force Majeure

Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, fire, flood, pandemic, war, civil unrest, government action, telecommunications or internet outages, strikes, or blockades.

21.Amendments

We reserve the right to amend these Terms at any time at our sole discretion. Amended Terms take effect upon publication on this page with an updated effective date. Your continued use of onlytrend.shop after publication constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

22.Complaints & Dispute Resolution

23.Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of the State of Kuwait, including Decree Law No. 10 of 2026 (Digital Commerce), Consumer Protection Law No. 39 of 2014, Electronic Transactions Law No. 20 of 2014, Data Protection Regulation No. 26 of 2024, Cybercrime Law No. 63 of 2015, and the Kuwait Civil and Commercial Codes. Any dispute not resolved amicably shall fall under the exclusive jurisdiction of the competent courts of Kuwait. If any provision is held unenforceable, the remaining provisions continue in full effect.
